5. Terms of Use

By accessing or using ReSMS, the user agrees to the following terms:

Eligibility: The platform is intended for professional use only (companies, developers, etc.). By using the service, you confirm that you are acting in a professional capacity.
Usage: Users are responsible for the content of messages sent using the platform. Illegal, fraudulent, abusive, or unsolicited (spam) SMS are strictly prohibited. ReSMS reserves the right to suspend or terminate any account violating this policy.
Data: Users agree to only use phone numbers they are authorized to message. ReSMS does not sell or share user data with third parties, except where required by law.
Sender IDs: Users can create custom sender IDs subject to regulatory and AWS policies. ReSMS cannot guarantee approval or deliverability of custom sender IDs.
Availability: While ReSMS strives for a high level of availability, no absolute guarantee is given. The service may be subject to temporary interruptions, particularly due to AWS availability or maintenance operations.
Billing: Users are billed monthly or based on their selected plan. Usage over quota will be billed separately or limited. Downgrades take effect at the end of the current billing cycle. Upgrades apply immediately with pro-rata pricing based on SMS consumption.

6. Limitation of Liability

ReSMS shall not be liable for:

Loss of revenue, data, or profits due to delayed, undelivered, or failed SMS messages.
Regulatory rejections or legal consequences related to the content of messages sent by users.
External services (such as AWS) failures, interruptions, or policy changes impacting delivery or usage.

Users assume full responsibility for complying with SMS laws in their target countries (e.g., GDPR, TCPA, etc.).

7. Intellectual Property

All content, trademarks, and logos on this website are the property of ReSMS or their respective owners. Any reproduction, distribution, or modification without prior written permission is prohibited.

8. Governing Law and Jurisdiction

These terms are governed by French law. Any disputes arising out of or in connection with the use of ReSMS will fall under the exclusive jurisdiction of the competent courts of Nantes, France.
