These Terms of Service govern your use of ReSMS, a platform enabling developers to easily integrate SMS functionality into their websites. By using our services, you agree to these terms. The service is intended for professional use only.

3. Services Provided

We provide tools for sending SMS via AWS, viewing sent messages, analyzing them through metrics, managing sender IDs, handling billing, and creating webhooks.

4. Account and Access

To access the services, users must register an account. You are responsible for maintaining the confidentiality of your credentials.

5. Responsibilities

You are responsible for using the service in compliance with all applicable laws and regulations. Use for spam or unauthorized messaging is strictly prohibited. We reserve the right to temporarily suspend or limit access to the service in case of system maintenance or security threats.

6. Billing and Payments

Fees are charged based on your selected plan. Downgrades take effect at the end of the current billing cycle. Upgrades apply immediately and are charged proportionally, with a discount reflecting previous SMS consumption. For example, when upgrading from a €245 plan to a €400 plan after consuming 1,500 out of 3,000 SMS, a discount of €122.50 is applied (50% usage of the previous plan).

7. Data and Privacy

We handle user data in accordance with our Privacy Policy. By using the service, you consent to the collection and use of data as described.

8. Third-party Services

Our SMS infrastructure is powered by Amazon Web Services (AWS). We are not responsible for AWS outages or limitations.

9. Liability and Limitations

ReSMS is not liable for indirect damages, including lost profits or data, arising from the use or inability to use the service.

10. Termination

We may terminate or suspend access to the service at any time if a user violates these terms or applicable laws.

12. Modifications to Terms

We reserve the right to update or modify these Terms of Service at any time. Any significant changes will be notified to users via the platform. Continued use of the service after such changes constitutes acceptance of the new terms.

13. Force Majeure (Acts Beyond Our Control)

ReSMS shall not be held responsible for delays or failures in performance resulting from acts beyond its reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, Internet service interruptions, or failures in third-party services such as AWS.

14. Governing Law

These Terms are governed by French law. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Nantes, France.
